Chess League Terms of Service


Purpose of these Terms of Service

The purpose of these terms is to govern the activity of those who use the websites, and any services offered by those websites, of the Chess League (collectively referred to as our “site”), and also those who participate in the Chess League, even if not a user of the site. These websites include, but are not limited to, chessleague.cc, chat.chessleague.cc, cloud.chessleague.cc, content.chessleague.cc, and any other subdomain or domain owned by the Chess League and all their subpages.



Acknowledgement

By continued use of our site or services, you acknowledge that you have read and understood these Terms of Service, and agree to be bound by them.


If you do not agree with or cannot comply with these Terms of Service, then you may not use our site, but please let us know by emailing us at contact@chessleague.cc so we can try to find a solution. These terms apply to all visitors, users and others who wish to access or use this site.



Implied Agreements

By continued use of our site or services, you also acknowledge that you have read, and that you agree with, the following policies and regulations which are considered part of our Terms of Service, in that your continued usage of our site and/or services is contingent upon your understanding of and agreement with these policies and regulations.


Privacy Policy

Your use of our site is conditional to your acceptance of our Privacy Policy, which explains how we collect, safeguard, and disclose information that results from your use of our web pages, and if applicable, your membership in the Chess League. By agreeing to these Terms of Service, you acknowledge that you have read and understood that Privacy Policy.


Security Policy

Your use of our site is also conditional to your acceptance of our Security Policy, located on our Security page, which explains the policies we have in place to ensure the safety and security of our members and other users. The Security Page acts as the top authority, and may override or invalidate any of these Terms of Service or any other rules or regulations of the Chess League, whether on or off the site. By agreeing to these Terms of Service, you acknowledge that you have read and understood that Security Policy.


Other Agreements

At other points in these Terms of Service, there may be a reference and link to another policy or list of regulations whose contents are not displayed directly within these Terms of Service. If at any point, these Terms of Service demand compliance with any policy, regulation, or other form or statute or limitation which is referenced and linked to, but is not directly written in full within these Terms of Service, it is your responsibility to follow those links and to read and accept all of those additional regulations, if applicable to you, if you wish to continue to use our site or services.



Membership Terms

These specific terms apply only to members of the Chess League or those looking to become a member, regardless of their use or planned use of the Chess League website. Before applying to become a member, you must agree to these Membership Terms, even if you do not sign up online.


Eligibility

In order to apply to become a member, you must meet certain eligibility requirements, and by applying to become a member, you acknowledge that you meet all such requirements. These requirements are listed on our Membership page.


Membership Rules

In addition to compliance with the entirety of these Terms of Service when using the Chess League website, members are held to an additional set of rules and regulations governing their conduct which must be adhered to during their membership. These rules are applicable to every member, regardless of whether or not they access or utilize the Chess League website, and are located here. It should be noted that some services of the Chess League may be provided wholly or partially in person, and that this fact does not reduce or remove any member’s accountability to these member-specific rules.


Application Process

Our application process has been constructed in a way that guides you through the necessary and required steps to apply for a membership. Any attempt to bypass the controls set in place by the Chess League is prohibited, and may result in you not being granted a membership. Additionally, we ask that if/when you share a link to others for the purpose of prompting them to apply for a membership, you use the link "https://chessleague.cc/membership" or "https://chessleague.cc/overview".


Accuracy of Information

When applying to become a member, it is important that you answer honestly and accurately every question in the fields provided. If you have reason to believe any of the information you submitted in your application was false, please contact us as soon as possible at membership@chessleague.cc, using the same email you entered when applying (unless that email address was the inaccurate piece of information), and we will update your information accordingly.


In addition to contacting us regarding accidentally-entered false information, we would appreciate an update if/when any of your information changes after your initial application. While there is no penalty for accidentally entering wrong information or for failing to update us with any new information, we may terminate your membership if we find out that you have knowingly entered false information in your membership application or in any other form, application, or questionnaire issued by the Chess League with which you take part while a member or while applying to become a member.


Confidentiality

During your membership in the Chess League, especially if you participate often in seasons and other activities, you will be given certain information that should be kept to yourself. While, unless otherwise specified in a specific season or other case, it is not inherently considered a violation of these terms to share such information with others, either knowingly or accidentally, it is strongly recommended for your benefit that you do not, especially since some of the information, including your member ID and some links, are permanent and cannot be changed, even if others become aware of what they are.


Member ID

Your approved membership in the Chess League will result in you receiving a member ID. This five-digit number may be used from time to time as a confirmation of your identity and membership when registering for a season, etc. Although this member ID cannot be used by itself in an attempt to impersonate you without knowledge of your other information, someone else’s knowledge of your Member ID could potentially result in them trying to register you for a season or perform another action as if it were being done by you. Since, in most cases, these actions are only allowed to be performed by the one whom the action is pertaining to (as in the case of season registration), there is no practical reason for sharing your member ID, and it is strongly advised that you do not share, or place anywhere that others can easily access, your member ID.


Password(s)

Depending on the system we are using to manage dashboard log-ins, you may be issued one or more passwords to assist you in accessing a certain page or multiple pages accessible only to you, or in some cases accessible only to your season or other corresponding group (in the latter case, more than one person may be given the same password to access a page - such will be clarified at the time). The password may or may not need to be accompanied by a username, but in either case, you are responsible for maintaining the confidentiality of your password, including but not limited to the restriction of access to your computer and/or account(s). You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our site or a third-party service.


Unless otherwise specified, you have the ability at any time to change your password. Such action can be done via email (strictly to membership@chessleague.cc), or if you share an email account with someone else or have other reasons to question the security of this method of transfer on your part, you must still send an email initially using the email we have on file for you (as a security precaution), but may transfer the password itself to us by one of the means made available to you in our reply to your email, likely to include a direct phone call or an in-person information of the password.


As it relates to the protection of your password on the part of the Chess League, you should understand that we have no way to receive and implement your password without seeing and storing it as plain text, and that we do not use encryption methods used by many of the sites you’re likely accustomed to using on the internet. As such, we highly recommend that, if you do choose to use a password other than the one(s) we generate for you, you make sure it is unique, since using a reused password on a service like ours, which doesn’t utilize standard methods of encryption to handle your passwords, may significantly compromise the security of any other accounts with which you use that password. While we have every available safeguard in place to ensure the protection of your passwords and other private information, we do not guarantee the effectiveness of such efforts, and will not be held liable for any damages which may result from your provision of the Chess League with any of your information, including password(s).


More information on secure methods of information transfer can be found on our Security page. Additionally, you should notify us immediately upon becoming aware of any breach of security or unauthorized use of any account we have issued you or that you have created with us.


Link(s)

In addition to or in place of issuing you a password, you may be given a private link allowing you access to a webpage or any content that relates to your membership in the Chess League. Private links are considered such due to the low probability of them being discovered, whether by being typed or clicked, and does not necessarily refer to the state of visibility of the content once the link has been typed or clicked. If you are given a private link, you should be aware that, in most cases, knowledge of the link itself is the only thing needed to access that page, and accordingly, the link address should be treated with the same extent of confidentiality as a password. If you know your link and wish to visit your page while on a computer or browser accessible to others, it is recommended that you use a guest window to visit that page. When not using a guest window, even if you have deleted or plan to delete the site from your browsing history after visitation, it’s possible that the browser may still autofill the entire link in the future when a certain amount of it is typed. To prevent unauthorized access to pages that use private links, we may periodically switch out a portion of that link (known as the “key”), so that the old link no longer works. When we do this, we will either notify you directly of the new link, provide a constant place for you to log in using your password to obtain that new link, or both.



Discontinuation

If at any time, you’d like to discontinue your membership in the Chess League, you may inform us of this decision by emailing us at membership@chessleague.cc. Discontinuing your membership means you will no longer be able to benefit from many of the resources, materials, discounts, and services offered by the Chess League, including participation in any of our seasons.


You may want to note that discontinuing your membership, although it can be regained, is not a free tool to clean your record or activity with us, before intending to return with a fresh start. If you do decide to return as a member (provided you have that option, i.e: your membership hasn’t been terminated by us), you will inherit the same member ID, player tag, season standings and charges, etc, and will be reassigned to the same profile as you had before discontinuing your membership. Termination

At any point, we reserve the right to terminate the membership of any individual for any reason, including for any of the following actions:

  1. Violating these Terms of Service, if a user of our site or services.

  2. Failing, at any point, to meet the membership eligibility requirements, located at chessleague.cc/membership, even if you met them initially

  3. Failing to comply with the member-specific rules (located here)

  4. Failing to comply on a regular basis with the season regulations of three or more consecutive seasons

  5. Intentionally gaining unauthorized access to any dashboard, account, or other platform which is intended to viewed only by Chess League management and/or another member or entity, even if such access has been acquired by public means of the internet

  6. Manipulating or attempting to manipulate the season standings, displayed game outcomes, or other sensitive information which could potentially impact the winner of a season or the rankings, awards, charges, or sanctions of that player or any other player within that season

  7. Knowingly gaining access to and/or participating in any season you have not registered for and been approved to participate in, including but not limited to participating in chat rooms for those seasons, even if such access has been acquired by public means of the internet

  8. Participating in any activity meant to harm the authority, functionality, security, publicity, reliability, efficiency, or reputation of the Chess League, or any intentionally harmful or negligent activity targeting any member of the Chess League specifically because of their membership, or because of any reason directly resulting from their membership in the Chess League

  9. Obtaining any reputation, whether inside or outside of the Chess League, that would give justified reason for other members or participants to feel uncomfortable or threatened while engaging in interaction with that individual, especially when such a situation results in or is likely to result in an immediate decrease or declining trend in membership or season participation, or when it results in any other type of harm to the Chess League or its members, through reputation, etc

  10. Dying; member death will not be tolerated under any circumstances, and will immediately result in a termination of membership


Payments

While membership in the Chess League is completely free and lasts a lifetime, we hope to eventually expand our services to include the sale of products such as brand-merchandise and custom 3D-printed chess boards, and there may be instances in which you’d like to purchase one of these products from us. Also, in addition to our optional free seasons, we hope to provide optional paid seasons in which prizes (funded by a season fee), along with the traditional awards, are issued to the winners of the season. In the event that you wish to participate in any paid service or purchase any product of the Chess League, the below terms apply.


Card Information

If you wish to purchase any product or service made available through our site, you may be asked to supply certain information relevant to your purchase including but not limited to, your credit or debit card number, the expiration date of your card, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any card(s) or other payment method(s) in connection with any purchase; and that (ii) the information you supply to us is true, correct and complete.


Third Party Processing

We may employ the use of third party services for the purpose of facilitating payment and the completion of purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to the Payment section of our Privacy Policy.


Order Cancellation

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons. We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.


Refunds

Unless specified otherwise on an individual product, all products are subject to our Product Refund Policy.



Communication


Emails

Depending on your role in the Chess League, you may be provided an email address (alias) on the chessleague.cc domain ("domain" includes all subdomains) with which to send and/or receive emails. Your use of any such Chess League provided email addresses, including sending emails to any email address ending in chessleague.cc, constitutes your acceptance of the following terms:


  1. Email addresses on the domain chessleague.cc are intended to be used only for purposes relating to the Chess League.

  2. The Chess League will monitor email use and may disclose the content of email messages, even after they have been deleted, when, in the Chess League's sole discretion, there is a legitimate need to do so.

  3. Occasional personal use is permitted, but the Chess League reserves the right to monitor personal use to the same extent that it monitors business use.

  4. The Chess League's communication systems should not be used to set up or run a personal business, transmit offensive, derogatory, obscene, or illegal materials, or download such material from the internet.

  5. Users of any Chess League provided email address should not expect that such emails, even if marked as personal or accessed by a personal I.D., are private or confidential.

  6. Users should exercise the same restraint and caution in drafting and transmitting email messages as when writing a formal memorandum on company letterhead. Users should assume that messages will be saved and reviewed by someone other than the original addressee.

  7. Use of the Chess League's communication systems constitutes consent to monitoring.

  8. Continued use of the systems is conditioned on acceptance of and strict adherence to these terms, and failure to adhere to the policy's requirements may result in termination of membership or other applicable role.


Newsletters

By using our site, you agree to receive and/or subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing us at contact@chessleague.cc.


Feedback

You may provide us either directly at contact@chessleague.cc or via third party sites and tools with information and feedback concerning errors, suggestions for improvements, ideas, problems, complaints, and other matters related to our site. You acknowledge and agree that:

  1. You shall not retain, acquire or assert any intellectual property right or other right, title or interest in or to the feedback

  2. The Chess League may have development ideas similar to the Feedback

  3. Feedback does not contain confidential information or proprietary information from you or any third party

  4. The Chess League is not under any obligation of confidentiality with respect to the Feedback. In the event the transfer of the ownership to the Feedback is not possible due to applicable mandatory laws, you grant the Chess League and its affiliates an exclusive, transferable, irrevocable, free-of-charge, sub-licensable, unlimited and perpetual right to use (including copy, modify, create derivative works, publish, distribute and commercialize) feedback in any manner and for any purpose.



Site Content


Intellectual Property

Our site and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of the Chess League and its licensors. Our site is protected by copyright, trademark, and/or other laws of foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of the Chess League. The unauthorized use of our services or content that is created from use of our services, including our scheduling API, for purposes outside of the Chess League is copyright infringement and may be punishable by law.


External Links

Our site may contain links to third party web sites or services that are not owned or controlled by the Chess League.

The Chess League has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites.


You acknowledge and agree that the Chess League shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third party web sites or services.

Content Access Withdrawal

We reserve the right to withdraw or amend our site, and any service or material we provide via our site, in our sole discretion without notice. We will not be liable if for any reason all or any part of our site is unavailable at any time or for any period. From time to time, we may restrict access to some parts of our site, or the entire site, to users, including members, for any reason.



User Content


Sharing of User Content

Our site allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material. You are responsible for content that you post on or through our site, including its legality, reliability, and appropriateness. By posting content on or through our site, you represent and warrant that: (i) the content is yours (you own it) and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms, and (ii) that the posting of your content on or through our site does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity. We reserve the right to terminate the membership or account of anyone found to be infringing on a copyright.


You retain any and all of your rights to any content you submit, post or display on or through our site and you are responsible for protecting those rights. We take no responsibility and assume no liability for the content you or any third party posts on or through our site. However, by posting content using our site, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such content on and through our service. You agree that this license includes the right for us to make your content available to other users of the site, who may also use your content subject to these terms. The Chess League has the right but not the obligation to monitor and edit all Content provided by users.


In addition, content found on or through this site are the property of the Chess League or are used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us.


Copyright Policy

We respect the intellectual property rights of others. It is our policy to respond to any claim that content posted on our site infringes on the copyright or other intellectual property rights (“Infringement”) of any person or entity. If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to contact@chessleague.cc, with the subject line: “Copyright Infringement” and include in your claim a detailed description of the alleged Infringement as detailed below, under “Claims of Copyright Infringement”. You may be held accountable for damages (including costs and attorneys’ fees) for misrepresentation or bad-faith claims on the infringement of any content found on and/or through our site on your copyright.


Claims of Copyright Infringement

You may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):

  1. an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright’s interest;

  2. a description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work;

User Conduct


Prohibited Uses

You may use our site and services only for lawful purposes and in accordance with these terms. You agree not to use our site:

  1. In any way that violates any applicable local, state/providence, national, or international law or regulation.

  2. For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.

  3. To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail”, “chain letter,” “spam,” or any other similar solicitation.

  4. To impersonate or attempt to impersonate the Chess League, a Chess League employee, another user, or any other person or entity.

  5. In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.

  6. To engage in any conduct that restricts or inhibits anyone’s use or enjoyment of our site, or which, as determined by us, may harm or offend us or the users of our site or expose them to liability.

  7. In any way which otherwise violates these Terms of Service.


Additionally, you agree not to:

  1. Use our site in any manner that could disable, overburden, damage, or impair the site or interfere with any other party’s use of the site, including their ability to engage in real time activities through the site.

  2. Use any robot, spider, or other automatic device, process, or means to access our site for any purpose, including monitoring or copying any of the material on our site.

  3. Use any manual process to monitor or copy any of the material on our site or for any other unauthorized purpose without our prior written consent.

  4. Use or implement any device, software, or routine that interferes with the proper working of our site.

  5. Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.

  6. Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of our site, the server on which our site is stored, or any server, computer, or database connected to our site.

  7. Attack our site via a denial-of-service attack or a distributed denial-of-service attack.

  8. Take any action that may damage or falsify company rating.

  9. Otherwise attempt to interfere with the functionality of our site.



Age Restrictions


Use by Those Under Thirteen

Our site is intended only for access and use by individuals at least thirteen (13) years old, unless parental consent has been granted to that individual. By accessing or using our site, you warrant and represent that you are at least thirteen (13) years of age (or have parental consent) and with the full authority, right, and capacity to enter into this agreement and abide by all of the terms and conditions of these terms. If you are under thirteen (13) years old and do not have parental consent you are prohibited from both the access and usage of our site and services.


While visitors are not directly requested by the site to indicate their age in order to access and/or use a number of our services (an exception includes acquisition of a membership), they are still bound to this restriction.



Liability


Limitation of Liability

Except as prohibited by law, you will hold us and our officers, directors, employees, and agents harmless for any indirect, punitive, special, incidental, or consequential damage, however it arises (including attorneys’ fees and all related costs and expenses of litigation and arbitration, or at trial or on appeal, if any, whether or not litigation or arbitration is instituted), whether in an action of contract, negligence, or other tortious action, or arising out of or in connection with this agreement, including without limitation any claim for personal injury or property damage, arising from this agreement and any violation by you of any federal, state, or local laws, statutes, rules, or regulations, even if company has been previously advised of the possibility of such damage. Except as prohibited by law, if there is liability found on the part of the company, it will be limited to the amount paid for the products and/or services, and under no circumstances will there be consequential or punitive damages. some states do not allow the exclusion or limitation of punitive, incidental or consequential damages, so the prior limitation or exclusion may not apply to you.


Disclaimer of Warranty

The Chess League hereby disclaims all warranties of any kind, whether express or implied, statutory, or otherwise, including but not limited to any warranties of merchantability, non-infringement, and fitness for particular purpose. The foregoing does not affect any warranties which cannot be excluded or limited under applicable law.


Additionally, any services provided by the Chess League are on an “as is” and “as available” basis. The Chess League makes no broad representations or warranties of any kind, express or implied, as to the operation of their services, or the information, content or materials included therein. You expressly agree that your use of these services, their content, and any services or items obtained from us is at your sole risk.


Neither the Chess League nor any person associated with the Chess League makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy, or availability of the services. Without limiting the foregoing, neither the Chess League nor anyone associated with the Chess League represents or warrants that the services, their content, or any services or items obtained through the services will be accurate, reliable, error-free, or uninterrupted, that defects will be corrected, that the services or the server that makes it available are free of viruses or other harmful components or that the services or any services or items obtained through the services will otherwise meet your needs or expectations.



Enforcement


Access Termination

We may terminate or suspend your access to our site immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of our terms. All provisions of our Terms of Service which by their nature should survive termination, shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.


Waiver and Severability

No waiver by the Chess League of any term or condition set forth in our Terms of Service shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Chess League to assert a right or provision under these terms shall not constitute a waiver of such right or provision.

If any provision of our Terms of Service is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of Terms will continue in full force and effect.


Governing Law

These terms are governed and construed in accordance with the laws of the United States, which governing law applies to agreement without regard to its conflict of law provisions.


Our failure to enforce any right or provision of these terms will not be considered a waiver of those rights. If any provision of these terms is held to be invalid or unenforceable by a court, the remaining provisions of these terms will remain in effect. These terms constitute the entire agreement between us regarding our site and supersede and replace any prior agreements we might have had between us regarding our site.



Changes to These Terms of Service

We may amend these terms at any time by posting the amended terms on this site. It is your responsibility to review these terms periodically.

Your continued use of our site and services following the posting of revised terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

By continuing to access or use our site after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use our site.
